Nigeria arbitration victory saves $6.2m as tribunal dismisses European contractor claims, reinforcing public sector project oversight

Nigeria has secured a significant international arbitration victory against European Dynamics UK Ltd, a European technology contractor, averting potential financial exposure of over $6.2 million (approximately N9.3 billion).

The tribunal dismissed all claims by the contractor, a ruling described as final and not subject to appeal.

The dispute arose from a national e-Procurement project overseen by the Bureau of Public Procurement (BPP). European Dynamics had claimed $2.4 million for alleged milestone completions, $3 million in general damages, and an additional $800,000 in settlement costs.

The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi, praised the outcome, declaring it a landmark for public sector contracting.

“It is no longer business as usual,” he stated, commending the legal team led by Johnson & Wilner LLP with Basil Udotai, Esq. as lead counsel.

The arbitration centred on deficiencies identified during User Acceptance Testing, which highlighted critical omissions and performance errors in the e-Procurement system.

The tribunal upheld Nigeria’s position that software delivery is performance-validated, and any defects were the contractor’s responsibility to remedy at no additional cost.

The ruling further confirmed that multi-phase contract payments could not be merged without bureau consent, reinforcing clear milestone definitions and contractual compliance.

Speaking after the award was presented to the AGF, Dr Adebowale Adedokun, Director-General of the BPP, emphasised the significance of the victory for public sector technology projects.

“This vendor has won cases across Africa, but Nigeria stood its ground and prevailed. The decision preserves billions of naira for national development,” he said.

Fagbemi added that the outcome sends a strong message internationally, signalling Nigeria’s resolve to safeguard its resources and institutional integrity.

He also highlighted the administration of President Bola Ahmed Tinubu for supporting justice sector reforms that strengthen institutional capacity.

The ruling reinforces the importance of rigorous testing, clear milestone definitions, and expert-driven software standards in government technology projects.

Lessons from the arbitration will be incorporated into ongoing e-procurement reforms to minimise future disputes and strengthen contract oversight.
