Court withdraws rape charge against Covenant University lecturer after Ogun prosecutors fail to present witnesses; judge rules discharge, not acquittal

Court withdraws rape charge in a case involving a former Covenant University lecturer, Stephen Ukenna, after the Ogun State High Court struck out the matter due to the prosecution’s inability to present witnesses.

The court, sitting in Ilaro and presided over by Justice A.A. Shobayo, delivered the ruling on June 5, 2024, following an application from the state’s Director of Public Prosecution (DPP).

The state’s lawyer, O. Osunsami, explained that repeated efforts to bring witnesses had failed.

Ukenna was facing charges related to the alleged rape of a 17-year-old female student in 2021. According to earlier police reports, he allegedly lured the student under false pretenses and sexually assaulted her in his office.

The defense did not oppose the state’s withdrawal motion. In response, Justice Shobayo ruled, “Defendant is hereby discharged but not acquitted.”

This ruling, while technically a discharge, leaves the possibility open for re-prosecution—especially if new evidence or witnesses emerge.

Legal experts note that such outcomes, though procedural, can impact public perception and victim trust in the justice system.

The high-profile nature of the case and the emotional weight of the allegations continue to stir debate over how rape cases are handled, especially when prosecution witnesses fail to appear.

Ukenna, previously a lecturer in the Department of Business Management, had been arrested in March 2021 following police investigations.

The incident reportedly shocked the university community and prompted swift action from local law enforcement.
